What is a Proof of Service?

Process Servers have a duty to their customers, the courts, and the party to be served to provide evidence that a legal document has been properly served on a party or a witness in a law suit; this is known as a Proof of Service (POS).

This declaration, signed under penalty of perjury by the server, must be filed with the court stating the date, time, manner of service, and the documents served. Failure to file the proof of service in a timely manner (Always check with your state and local laws for the time allowed to file your particular POS) may delay or jeopardize a case.
