Stake Out an Evading Defendant

A stakeout, in serving legal documents, is a technique used in situations on a defendant or witness attempting to evade service. The process server physically waits on-site and uses visual observation to monitor the location. They stay within close proximity to the home or business of the individual and wait for that person to come out and be within normal speaking distance to inform the defendant of the general nature of the documents. Stakeouts can be as simple as waiting outside their home until they come out to more complex situations like serving a musician as they are getting ready to perform on the stage.

Costs of a stake out can vary depending on several factors including the situation, the amount of time spent on the stake out, and the attorney services company.
